Accommodation terms and conditions

(Scope of application)

Article 1

  1. Accommodation contracts and related contracts entered into by our hotel with guests shall be as stipulated in these terms and conditions, and matters not stipulated in these terms and conditions shall be governed by laws and regulations or generally established customs. Masu.
  2. If the Hotel accepts a special agreement to the extent that it does not violate laws and customs, that special agreement shall take precedence, notwithstanding the provisions of the preceding paragraph.

(Application for accommodation contract)

Article 2

  1. A person who wishes to apply for an accommodation contract with this hotel must provide the following information to the hotel.
    1. Guest name
    2. Accommodation date and estimated time of arrival
    3. Accommodation charges (as a general rule, according to the basic accommodation charges in attached table 1)
    4. Other matters determined by the hotel as necessary.
  2. If a guest requests to continue staying beyond the accommodation date set forth in item 2 of the preceding paragraph during their stay, the hotel will treat the request as having been applied for a new accommodation contract at the time the request is made. I assume that.

(Establishment of accommodation contract, etc.)

Article 3

  1. The accommodation contract shall be concluded when the hotel accepts the application set forth in the preceding article. However, this does not apply if the hotel proves that it has not consented.
  2. If an accommodation contract is concluded in accordance with the provisions of the preceding paragraph, the application fee specified by the hotel, which is limited to the basic accommodation fee for the period of stay (or 3 days if it exceeds 3 days), must be paid by the date specified by the hotel.   3. The application fee will first be applied to the accommodation fee that the guest ultimately has to pay, and if a situation arises in which the provisions of Articles 6 and 17 apply, the application fee will be applied to the cancellation fee and then to the compensation. If there is any remaining amount, it will be returned at the time of payment of fees pursuant to Article 12.
  4. If the application fee set forth in Paragraph 2 is not paid by the date specified by the Hotel pursuant to the provisions of the same paragraph, the Accommodation Contract shall become invalid. However, this only applies if the hotel notifies the guest of this fact when specifying the due date for payment of the application deposit.

(Special agreement that does not require payment of application fee)

Article 4

  1. Notwithstanding the provisions of Paragraph 2 of the preceding article, the Hotel may accept a special agreement in which the payment of the application fee set forth in the same paragraph is not required after the conclusion of the contract.
  2. When accepting an application for an accommodation contract, if the hotel does not request payment of the application deposit as set forth in Paragraph 2 of the preceding article or does not specify the payment date for the application deposit, it will be treated as acceptance of the special contract as set forth in the preceding paragraph. (Refuse to conclude accommodation contract)

Article 5

The hotel may not accept the conclusion of an accommodation contract in the following cases.

  1. When the application for accommodation does not comply with these terms and conditions
  2. When there are no rooms available due to full occupancy
  3. When it is recognized that there is a risk that the person seeking accommodation may engage in acts that violate the provisions of laws and regulations, public order, or good morals regarding accommodation.
  4. When the person seeking accommodation is deemed to fall under any of the following イ to ハ:
    1. Organized crime groups as defined in Article 2, Item 2 of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991) (hereinafter referred to as "organized crime groups"); (hereinafter referred to as "organized crime group members"), members of organized crime groups, persons associated with organized crime groups, and other anti-social forces.
    2. When an organized crime group or organized crime group member is a corporation or other organization that controls business activities.
    3. Corporations whose officers are members of organized crime groups
  5. When a person seeking accommodation engages in behavior that causes significant inconvenience to other guests.
  6. When the person seeking accommodation is clearly recognized as having a contagious disease.
  7. When violent demands are made regarding accommodation or a burden that exceeds a reasonable range is demanded.
  8. When accommodation is not possible due to natural disasters, facility failures, or other unavoidable reasons.
  9. In cases stipulated in Article 5 of the Tokyo Metropolitan Hotel Business Law Enforcement Ordinance (when a person seeking accommodation is likely to cause trouble to other guests due to drunkenness, etc.; when the person engages in behavior that causes significant trouble to other guests) when applicable.

(Guest's right to cancel contract)

Article 6

  1. Guests may cancel their accommodation contract by notifying the hotel.
  2. If the guest cancels all or part of the accommodation contract due to reasons attributable to the guest, the hotel will cancel the accommodation contract in whole or in part due to reasons attributable to the guest(pursuant to the provisions of Article 3, Paragraph 2, the hotel will specify the payment date of the application fee and (excluding cases where the guest cancels the accommodation contract before the payment is made), the guest will be charged a penalty as listed in Attached Table 2. However, in the event that our hotel accepts the special agreement set forth in Article 4, Paragraph 1, in accepting the special agreement, we will notify the guest of the obligation to pay a penalty when the guest cancels the accommodation contract. Only when notified.
  3. If the guest does not arrive by 8:00 p.m. on the day of accommodation (if the arrival time is specified in advance, 2 hours after that time) without contacting the hotel, the hotel will cancel the accommodation. The contract may be treated as having been canceled by the guest.

Article 7

  1. The hotel may cancel the accommodation contract in the following cases.
    1. When it is recognized that there is a risk that the Guest will engage in acts that violate legal provisions, public order, or good morals regarding accommodation.
    2. When the Guest is deemed to fall under any of the following イ to ハ:
      1. Organized crime groups, organized crime group members, organized crime group associate members, organized crime groups, and other anti-social forces
      2. When an organized crime group or organized crime group member is a corporation or other organization that controls business activities.
      3. Corporations whose officers are members of organized crime groups
    3. When a guest engages in behavior that causes significant inconvenience to other guests.
    4. When a guest is clearly recognized as having a contagious disease.
    5. When violent demands are made regarding accommodation or a burden that exceeds a reasonable range is demanded.
    6. When accommodation is not possible due to reasons caused by force majeure such as natural disasters.
    7. When a person intending to stay overnight is deemed to be at risk of causing a nuisance to other guests, such as entering the guest room due to drunkenness, or when the person engages in behavior that causes a significant nuisance to other guests.
    8. When smoking while sleeping in the bedroom, tampering with firefighting equipment, etc., or not complying with any other prohibitions stipulated by the Hotel's rules of use (limited to those necessary for fire prevention).
  2. When the hotel cancels the accommodation contract based on the provisions of the preceding paragraph, the guest will not be charged for accommodation services, etc. that have not yet been provided to the guest.

(Registration of accommodation)

Article 8

  1. Guests must register the following information at the front desk of our hotel on the day of their stay.
    1. Guest's name, age, gender, address and occupation
    2. For foreigners, nationality, passport number, place of entry, and date of entry
    3. Departure date and scheduled departure time
    4. Other matters deemed necessary by the hotel
  2. If the Guest intends to pay the charges set forth in Article 12 using a method that can be substituted for currency, such as a traveler's check, accommodation voucher, or credit card, the Guest must present these in advance at the time of registration as set forth in the preceding paragraph.

(Room usage time)

Article 9

  1. Guests may use the hotel's guest rooms from 3:00 pm to 10:00 am the next morning. However, if you stay for consecutive nights, you can use it all day except for the day of arrival and departure.
  2. Notwithstanding the provisions of the preceding paragraph, the hotel may accept use of guest rooms outside of the hours specified in the same paragraph. In this case, the following additional charges will be charged.
    1. For up to 3 extra hours, 1/3 of the room charge will be charged.
    2. For up to 6 hours, 1/2 of the room charge will be charged.
    3. For over 6 hours or more, the full room charge will be charged.

Article 10

Guests must comply with the rules of use established by the Hotel and posted within the Hotel.

(business hours)

Article 11

  1. The business hours of our hotel's facilities, etc. will be announced on our website, pamphlets provided, bulletin boards in various locations, service directories in guest rooms, etc.
  2. Business hours may be changed temporarily if necessary. In that case, we will notify you in an appropriate manner.

(Payment of fees)

Article 12

  1. The details of the accommodation charges, etc. to be paid by the Guest and the method of calculation thereof are as listed in Attached Table 1.
  2. Payment of the accommodation fee set forth in the preceding paragraph shall be made in currency or by alternative methods approved by the hotel, such as traveler's checks, accommodation coupons, credit cards, etc., at the front desk upon the guest's arrival or when requested by the hotel.   3. Even if the guest voluntarily chooses not to stay after the hotel has provided a guest room to the guest and the guest is able to use the room, the accommodation fee will still be charged.

(Hotel's responsibility)

Article 13

  1. The Hotel will compensate the Guest for any damage caused to the Guest in the performance of the Accommodation Contract and related contracts, or in the event of non-fulfillment thereof. However, this does not apply if this is not due to reasons attributable to the Hotel.
  2. Our hotel regularly conducts fire safety inspections based on the Fire Service Act, but in order to deal with the unlikely event of a fire, we have taken out hotel liability insurance.

(Handling when the contracted guest room cannot be provided)

Article 14

  1. If the hotel is unable to provide the guest with the contracted room, the hotel shall, with the consent of the guest, arrange for other accommodations with the same conditions as possible.
  2. Notwithstanding the provisions of the preceding paragraph, if the hotel is unable to arrange other accommodations, the hotel will pay the guest a compensation fee equivalent to the cancellation fee, and the compensation fee will be applied to the amount of damages. However, if there is no reason attributable to the hotel for the inability to provide a guest room, no compensation fee will be paid.

(Handling of deposited items, etc.)

Article 15

  1. In the event that damage such as loss or damage occurs to goods, cash, or valuables left at the front desk by the Guest, the Hotel will compensate for such damage, unless the damage is caused by force majeure. However, with regard to cash and valuables, if the Hotel requests a declaration of the type and value of the item and the Guest fails to do so, the Hotel will be liable for damages up to 150,000 yen. I will compensate you.
  2. In the event that damage such as loss or damage occurs to goods, cash, or valuables brought into the hotel by the guest that are not deposited at the front desk due to intentional or negligent behavior on the part of the hotel. , the hotel will compensate for the damage. However, for items for which the type and value have not been disclosed in advance by the guest, the hotel will compensate for damages up to 150,000 yen, unless there is intentional or gross negligence on the part of the hotel.

(Storage of guest's baggage or personal effects)

Article 16

  1. If the guest's baggage arrives at the hotel prior to their stay, the hotel will take responsibility for storing it and hand it over to the guest when checking in at the front desk, only if the hotel agrees to do so prior to the guest's arrival. .
  2. If the guest's baggage or personal effects are left behind at the hotel after the guest has checked out, and the owner is identified, the hotel will contact the owner and provide instructions. shall be sought. However, if there is no instruction from the owner or if the owner cannot be identified, the item will be kept for a maximum of 7 days including the date of discovery, and then delivered to the nearest police station.
  3. In the case of the preceding two paragraphs, the hotel's responsibility for the storage of the guest's baggage or personal effects shall be in accordance with the provisions of paragraph 1 of the preceding article in the case of paragraph 1, and in the case of the preceding paragraph with the provisions of the same article. The provisions of Section 2 shall apply.

(Guest's responsibility)

Article 17

If the Hotel suffers damage due to the intentional or negligent act of the Guest, the Guest shall compensate the Hotel for the damage.

(Jurisdictional court and applicable law)

Article 18

Disputes regarding accommodation contracts between our hotel and guests shall be governed by Japanese law, and the district court or summary court with jurisdiction over the location of our hotel shall have exclusive jurisdiction in the first instance.

(Disclaimer)

Article 19

Guests are responsible for using computer communications from within the hotel. The hotel will not be held responsible for any damages sustained by the guest as a result of service interruption due to system failure or other reasons while using computer communications. In addition, if damage is caused to the hotel or a third party due to conduct that the hotel deems inappropriate when using computer communications, the guest will be required to compensate for the damage.

1.If the tax laws and regulations are revised, the above accommodation tax and consumption tax will be based on the revised provisions.
2.For more information on accommodation tax, it is levied based on the Tokyo Metropolitan Accommodation Tax Ordinance.

Attached Table 2: Penalty (Related to Article 6, Paragraph 2)

(Note)1. % is the ratio of the penalty fee to the basic accommodation fee.
2.If the number of contract days is shortened, a penalty fee of one day will be collected regardless of the number of days shortened.
3.If the contract is canceled for part of a group of guests (15 or more people), 10% of the number of guests in case of fractions There will be no penalty charge for the number of people in the group (rounded up to the nearest 70%).
4.If individual cancellation fees are set for each accommodation plan, the cancellation fee provisions for each accommodation plan will take precedence.
